U.S. appeals court revives lawsuit vs United Airlines over wheelchair

SAN FRANCISCO (Reuters) - A U.S. appeals court on Tuesday revived a lawsuit against United Continental Holdings Inc's United Airlines that was brought by a woman who claimed she was not promptly provided a wheelchair in an airport when she asked for one.
The opinion, from the 9th U.S. Circuit Court of Appeals in San Francisco, said federal law did not pre-empt the woman's personal injury claims under state law.
A representative for United could not immediately be reached for comment.
Mark Meuser, an attorney for plaintiff Michelle Gilstrap, who has difficulty walking, said some lower court judges had disagreed about whether individuals should be able to bring claims for injuries in an airplane or terminal.
"This is a really big deal for disabled Americans across the country," Meuser said.
Gilstrap had difficulty walking due to a collapsed disc in her back and osteoarthritis, according to the court opinion. During two separate plane trips in 2008 and 2009, she alleged that United failed to supply a wheelchair on some occasions.
She also said United agents yelled at her, doubted whether she really needed a wheelchair and ordered her to stand in line, which she could not do because of her condition.
Gilstrap sued, and a Los Angeles federal judge dismissed her case. In Tuesday's three-judge ruling, the 9th Circuit said Gilstrap could not pursue her claims under the Americans for Disabilities Act.
However, the court ruled that Gilstrap's claims, including emotional distress and negligence, under state law were not pre-empted by the Air Carrier Access Act. The appeals court remanded the case for further proceedings.
The case in the 9th Circuit is Michelle Gilstrap vs. United Air Lines Inc., 11-55271.

United places order for Airbus A350-1000 aircraft
United has placed an order with Airbus for new A350-1000 aircraft. The agreement converts United’s existing order for 25 A350-900s into A350-1000s and adds 10 firm orders for A350-1000s, giving the airline a total order of 35 aircraft.
The increased seating capacity of the A350-1000 will enable United to replace older, less efficient aircraft currently serving long-range, high-demand markets. United expects delivery starting in 2018.
“We look forward to taking delivery of the A350-1000,” said Jeff Smisek, United’s chairman, president and CEO.
“This is a modern, fuel-efficient and advanced-technology aircraft that our customers and co-workers will enjoy flying. It will be a great addition to our fleet, and will allow us to meet demand on larger, long-haul markets in our world-leading network.”
The A350-1000 is the largest member of the A350 WXB family and uses advanced materials including composites, titanium and aluminum alloys combined with the latest engine technology to make it lighter and more fuel efficient.
The aircraft will consume approximately 20 percent less fuel per seat than the large widebody aircraft it will replace. It is powered by new-generation Rolls-Royce Trent engines. The cabin will offer an improved customer experience with more headroom, wider panoramic windows and more overhead storage space.
“Less than a week after the success of the A350 XWB’s first flight, we see that demand for the new aircraft continues to grow, especially for the larger -1000 model. Airbus is proud to have United Airlines on board the exciting A350 program in such a significant way,” said Fabrice Bregier, Airbus President and CEO.
The Airbus order supports United’s commitment to improve the overall efficiency of its fleet. On Tuesday, the airline announced an order for 10 Boeing 787-10 aircraft and conversion of 10 existing 787 orders to the -10 variant, making United’s total Dreamliner order book 65.
In July of last year, United announced a narrowbody order for 100 Boeing 737 MAX 9 aircraft and 50 Boeing 737-900ER aircraft. The airline is also modernizing its United Express fleet by adding seventy 76-seat Embraer aircraft that will be operated by regional partners.

Manchester United to begin title defence at Swansea
MANCHESTER - David Moyes was given a challenging start to life as Manchester United manager today (June 19), with his new team handed fixtures against Chelsea, Liverpool and Manchester City in the first five matches of its Premier League title defence.
Moyes already has a tough job replacing the great Alex Ferguson, who retired after nearly 27 trophy-laden years at Old Trafford, and the release of the 2013-14 fixture list has not given him any respite.
After opening its title defence at Swansea, United hosts Chelsea - also under a new manager in Jose Mourinho - the following weekend. Then United plays great rival Liverpool away before a trip to City on the weekend of Sept 21-22.
Mourinho’s first match in his second spell with Chelsea is at home to newly promoted Hull while Manuel Pellegrini’s first taste of action as City’s new manager comes at home to Newcastle.
“Starting the season at home is a great way for our supporters to show the players they are ready to be behind the team all the way, and at the same time it is a great way for the players to show how much they are motivated and committed,” Mourinho said.
“I am so happy to start at the Bridge.”
The opening round of the season takes place on the weekend of Aug 17-18.
Given all the managerial appointments among the big clubs, it is anticipated that this season’s title race will be one of the most hotly contested in years.
If it goes down to the last day - as it did two seasons ago - United will be away at Southampton, City is at home to West Ham and Chelsea visits Cardiff, one of the other promoted teams.
Arsenal begins the season at home to Aston Villa, Liverpool hosts Stoke and the first game in charge for new Everton manager Roberto Martinez is at Norwich. AP
